TheNational Association of Manufacturers (NAM) is seeking a Senior Litigation Counsel to litigate on behalf of the NAM’s 14,000+ members on a wide range of issues. The NAM’s litigation program consists of direct legal challenges to federal regulations and other government actions, interventions in support of the government to defend sensible regulatory reforms and other pro-manufacturing actions, and the filing of amicus curiae briefs to bring the voice of manufacturers to the courts on precedent-setting issues.
In a typical year, the NAM files 80-100 briefs through our amicus program and party litigation. The legal issues and topics on which we engage are as broad and diverse as the members we represent, ranging from labor and employment, energy and the environment, product liability, class actions, tax, trade, intellectual property, manufacturers’ free speech rights, False Claims Act, international issues, jurisdiction, administrative procedure, antitrust, arbitration, discovery, communications, insurance, and securities regulation.
This position will report to the NAM’s Vice President of Litigation and Deputy General Counsel (who in turn reports to the NAM’s Senior Vice President, General Counsel, and Corporate Secretary). The Senior Litigation Counsel will work very closely with the Vice President to identify, vet, manage, and resolve the cases under his or her responsibility. Following an initial training and familiarization period, the Senior Litigation Counsel will be expected to exercise independent judgment and operate with only moderate oversight.
Responsible for party litigation and amicus briefs in which NAM participates on legislative, regulatory, tort liability and other matters in support of the NAM membership.
Engages outside counsel, directs the legal strategy and arguments, and reviews and edits briefs drafted by outside counsel.
Identifies new litigation opportunities to strategically advance the interests of manufacturers and the manufacturing economy.
Builds and manages relationships with allied groups, including building and managing litigation coalitions.
Coordinates with the NAM’s Policy and Government Relations Department to assure compliance with NAM policy in all testimony and submissions.
Publicizes and explains legal case developments to NAM members, staff, the media and the general public as appropriate.
Works with members, outside counsel, and professional groups to advance the interests of manufacturers affected by litigation.
Builds and manages legal programming to support and educate the NAM’s members.

This position requires a J.D. from an accredited law school and membership in a state bar
Minimum of six years legal experience, with eight to twelve years preferred
Prior litigation experience in a major law firm, a federal regulatory agency, trade association, or major company is strongly preferred
Must have experience with federal and state litigation and have a firm understanding of litigation arising under the Administrative Procedure Act
Experience in any of the following legal fields is preferred but not required
Application of labor and employment law to manufacturing companies
Product liability law
Class action law
Excellent analytical, organizational and communication skills are essential
Strong project management and organizational skills
Strong interpersonal skills
Attention to detail and high degree of accuracy
Computer proficiency with Windows, Microsoft Office Suite (Word, Excel and Power Point), and the Internet
Strong team player
