Key Roles
Meets with, educates, fosters, and maintains good relationships with property owners. Establishes market analysis, negotiates and procures right-of-way easements, facility sites, and property acquisitions necessary to provide for the expansion of the system’s transmission network in a cost-effective manner. Maintains a working relationship with operations department on new and existing easements where encroachments are present.
Key Responsibilities
- Assists with site reconnaissance and establishing basic site requirements.
- Investigates courthouse records to determine property ownership.
- Schedules and coordinates “open house” meetings with property owners inside study corridors for new lines.
- Provides initial contact with land owners and seeks survey permission.
- Interprets legal documents such as contracts, deeds, easements, options, leases, permits and other documents and agreements.
- Makes real estate assessments of fee simple acquisition of properties purchased by EKPC and provides documentation to support said assessments.
- Researches and analyzes market data of comparable sales to determine the reduction in market value for property encumbered by EKPC transmission line easements for use in negotiations.
- Performs title research for fee acquisition, and for condemnations, submits preliminary condemnation suit data to Legal for final suit preparation.
- Investigates, gathers information, and completes property ties for condemnation proceedings.
- Provides data for and oversees production of condemnation plats.
- Acts as an agent for EKPC in negotiating settlements with land owners within “Right-of-Way Negotiation Guidelines” with direction from management only in those occurrences where normal guidelines are exceeded.
- Manages the right-of-way acquisition activities for individual projects as assigned and, otherwise schedules daily work and keeps supervision informed of locations and progress.
- Maintains a daily log of personal activity pertaining to negotiations and contacts.
- Acts as liaison between contractors, EKPC crews and property owners during the bid process, clearing and construction phases.
- Evaluates damage claims and settles or makes recommendation for settlement to the appropriate parties.
- Is authorized to write checks for options, services for recording fees, damages, down payments for easements, etc. as may arise during the normal course of work.
- Investigates encroachments, recommends and monitors action to be taken, follows up and maintains right-of-way records for the transmission system.
- Maintains time sheets, expense accounts, vehicle mileage reports, work progress reports, etc.
- Represents EKPC and educates the property owners about the transmission projects and procedures to be followed. Fosters and maintains a positive public image with property owners and the general public.
- Gathers, analyzes and enters information into right-of-way data base.
- Solicits quotes and secures the services of independent contractors for providing fencing, minor grade work, rock replacements, surveying, stump grinding, etc., according to established guidelines. Inspects the work done and accepts it on behalf of EKPC.
- Acts as a Notary Public for property owners and the Cooperative at large.
- Directs and oversees contract right of way services, assists in procurement of contract right-of-way service providers.
- Performs other duties as required or assigned.
Key Requirements
Education
- High School diploma or equivalent. Real Estate and/or land appraisal courses and licenses desirable.
Experience:
- Five (5) years of related experience.
Skills & Abilities:
- Must maintain a good working knowledge of land appraisal procedures.
- Knowledge of EKPC negotiation procedures essential.
- Should possess a general knowledge of survey methods relevant to property boundaries.
- A general knowledge of transmission systems and types and methods or transmission related construction helpful.
- Must maintain status as Notary Public.
- Must maintain a valid driver’s license.
- Knowledge of condemnation court proceedings helpful.
- Should understand administration of right-of-way clearing contracts.
- Must be able to relate tactfully to all types of personalities in a wide range of professions.
- Must possess effective written and oral communication skills.
- Must have sufficient computer skills to maintain right-of-way data base.
- Must have the ability to work independent of direct supervision.
- Must be able to read, understand, and interpret all maps and legal documents.
- Must possess ability to serve as an expert witness for litigation of land acquisitions.
- Basic computer skills (Word, Excel, Outlook, etc.) required.
